According to the New York State Division of Criminal Justice Services, in 2013 there were more than 100 forcible rapes reported to police in Onondaga County alone. There were more than 2,500 reported throughout all of New York State. Under New York law, rape is divided into three categories.

  • First-degree rape – Engaging in sexual intercourse with another person using forcible compulsion or someone who is incapable of consent due to being physically helpless or less than 13 years old.
  • Second-degree rape – Engaging in sexual intercourse with someone under the age of 15 or someone who is mentally disabled or incapacitated and therefore incapable of providing consent.
  • Third-degree rape – Engaging in sexual intercourse with someone incapable of providing consent for a reason other than being under the age of 17 or incapacity to consent.

Rape charges are classified as felonies and can lead to significant fines, probation and incarceration.
